These Terms & Conditions (“Terms”) govern your use of our website [https://www.tallowgardens.com] (the “Website”) and any online purchase you make from us.

If you do not agree to these Terms, please do not use the Website or place orders through it.

Applicability of Quebec consumer law

If you are a consumer residing in Quebec, your purchases are governed by Quebec law, including the Consumer Protection Act and the Civil Code of Québec. Nothing in these Terms limits your rights under those laws. If there is any conflict between these Terms and mandatory provisions of Quebec law, the law will prevail

Eligibility

By using this Website or placing an order, you confirm that:

  • You are at least the age of majority in your province or territory of residence, or you are using the Website under the supervision and consent of a parent or legal guardian; and

  • You are using the Website for personal/household purposes and not as another merchant or reseller.

Creating an account (if applicable)

You may be able to create an account on the Website. If you do:

  • You must provide accurate and complete information and keep it up to date.

  • You are responsible for keeping your login details confidential and for all activity under your account.

  • We may suspend or close an account if we reasonably believe there is misuse, fraud, or a breach of these Terms.

You can also purchase as a guest where the Website allows it.

Product information

We sell beef tallow and tallow-based products for cooking and/or personal care, depending on the product.

We aim to describe our products as accurately as possible (ingredients, size, weight, usage, etc.). However:

  • Colours, textures, and appearance may vary slightly from photos.

  • Minor variations in jar fills, labels, or packaging may occur.

If a product you receive does not match the description in any important way, you may have legal rights, including the legal warranty in Quebec (quality, reasonable durability, hidden defects). These rights are in addition to any return policy we offer.

Health, safety and allergy disclaimer

Some of our products are intended for food use (cooking, frying, etc.). Others are for external use only (skin care, etc.). Always follow the instructions and indications on the label and on the product page.

You are responsible for:

  • Checking ingredients for possible allergens or sensitivities;

  • Testing skin-care products on a small area before wider use;

  • Consulting a health professional if you have medical conditions, are pregnant or breastfeeding, or are unsure if a product is suitable for you.

Nothing in this section limits any legal warranty or mandatory responsibility we may have under Quebec law if a product is defective, dangerous, or not as described.

Ordering process and formation of the contract

  1. Placing an order

    • To place an order, add products to your cart, complete checkout, and submit your order.

    • Before submitting, you will see key information: product description, price, fees, taxes, delivery charges, and your total.

  2. Order confirmation

    • After you place an order, you will receive an email acknowledging receipt. This is not yet our acceptance.

    • The contract between you and us is formed when we send an email confirming that your order has been accepted and is being processed or shipped. This email and these Terms together form your distance contract under Quebec consumer law.Lexology+1

  3. Availability and refusal
    We may refuse or cancel all or part of an order, for example if:

    • The product is out of stock;

    • There is an error in price or description;

    • We suspect fraud or misuse;

    • The order appears to be for resale.

If we cancel after payment, we will refund the amounts paid for the cancelled items.

Prices, taxes and fees

  • All prices are shown in [Canadian dollars (CAD)] unless stated otherwise.

  • Applicable sales taxes (e.g. GST, QST) and shipping fees are added at checkout and shown before you confirm your order.

  • We may change prices, fees, and promotions at any time, but changes will not affect orders already accepted and confirmed.

If there is an obvious pricing error (for example, a product listed at $0.01 instead of $19), we are not required to honour that price. If you already ordered at that price, we will contact you and you may choose to cancel or reorder at the correct price.

Payment

  • Payment is processed by third-party payment services (e.g. [insert: Stripe / PayPal / Wix Payments / other]).

  • You authorize us and our payment provider to charge your selected payment method for the total amount (products, taxes, fees, shipping).

  • You must provide accurate billing information and confirm you are authorized to use the chosen payment method.

We do not store your full credit card number on our servers. Card data is handled by the payment provider, which applies its own security safeguards.

Shipping, delivery and transfer of risk

  • We ship to the addresses and regions listed on the Website.

  • Estimated delivery times are provided for convenience and are not guaranteed, but we aim to ship within reasonable delays.

  • Risk of loss or damage to the products passes to you when they are delivered to the address you provided, subject to your rights under Quebec law if goods arrive damaged or not conforming.

You are responsible for providing a correct and complete delivery address. If an order is delayed or returned because of an incorrect address, additional fees may apply.

Returns, refunds and cancellations

  • Any other liability that cannot be limited or excluded under applicable law.

18. Governing law and disputes

These Terms and any online purchase from us are governed by the laws of the Province of Quebec, and the laws of Canada that apply there.

Any dispute relating to these Terms or a purchase will be submitted to the competent courts of Quebec, in the judicial district ofMontreal, unless another forum is required by a mandatory rule of consumer protection law.
